The Baylor graduate who threatened to blow up campus buildings will get probation due to his diminished mental capacity.

David cunningham told a federal judge in Waco that he is sorry for threats he made to the campus and the Baylor police chief.  Cunningham says he never intended to commit the acts when he called in May from a Tyler hotel room.

Cunningham's attorney says Cunningham received head injury while playing rugby at Baylor which lead to a decline in his mental condition.
